There was a motion to accept the minutes of the April 24th meeting with a few changes.  The motion was seconded and accepted with a vote of 5-0-0.

There was a motion to accept the Executive Session minutes of the April 10th meeting with one change.  The motion was seconded and accepted with a vote of 4-0-1; 4 Yes, 0 No, 1 Abstention.

Mr. Nick Alfieri’s Agent’s Report has been appended to the minutes.


Public Hearing - Notice of Intent – Map 245, Lot 16  Pleasant Street – Thornhill - CE159-966
Mr. James Thornhill, the applicant, and Mr. Brian Gillis, Engineer of Dunn McKenzie, both appeared before the Commission for construction of single-family house, pool, deck and detached barn.  Mr. Gillis stated that the site is 4.29 acres in size.  Miller Brook is located adjacent to the property; which is a perennial stream with associated wetlands.

Mr. Gillis stated that the construction will be within the limit of work and also within the haybale line.  There will be no alteration within the 100 ft. buffer.  There will be 8,905 sq. ft. of alteration between the 100-200 ft. riverfront area.

Mr. Alfieri informed the applicant of 11 items to be addressed in this Notice of Intent filing.

A Commission member stated that an alternatives analysis for the single-family house lot has not been submitted and requested that a copy be submitted.

Mr. Charles Dellacona, an abutter of 670 Pleasant Street, expressed concerns regarding storm drainage runoff from the site onto his property.  The Chairman informed Mr. Dellacona that this is a Planning Board and DPW issue.

Mr. Thornhill stated that he has met with DPW personnel regarding the above-mentioned issue and has taken steps to address the recommendations of the Town Engineer.

There was a motion to continue the hearing until May 29th so that the Commission may conduct a site walk.  The Commission will conduct a site walk on Tuesday, May 20th at 6:30 p.m.  The motion was seconded and accepted with a vote of 5-0-0.


Continued - Public Hearing – Notice of Intent – Honey Dew Donuts – 365 West Central Street - CE159-965
Mr. Donald Nielsen, Engineer of Guerriere & Halnon, and Mr. Joe Paolino, the applicant, appeared before the Commission for the expansion of pavement for the parking lot for relocation of the drive thru at the Honey Dew Donuts site.  

Mr. Nielsen submitted revised plans to the Commission to address the stormwater management issues from DEP as an outstanding issue.

Mr. Alfieri informed the Commission and the applicant that the Town Engineer had 2 comments with regard to the drainage for the site.  The letter from Mr. Yadisernia has been added to the Conservation file and these comments will be addressed by the Planning Board.  

The Commission Chairman stated that there was no one in the audience who had any issues regarding this project.

A Commission member stated that a Commission member had requested at a previous meeting that the applicant replace the New York fern with hay scented fern as it has a much higher survival rate.

There was a motion to close the hearing.  The motion was seconded and accepted with a vote of 4-0-1; 4 Yes, 0 No, 1 Abstention.


Continued - Public Hearing – Notice of Intent – 49 Hancock Road – Arone - CE159-964
Mr. Donald Nielsen, Engineer of Guerriere & Halnon, appeared before the Commission for the construction of an in-ground swimming pool.  

Mr. Nielsen submitted revised plans to the Commission with 1 revision depicting a shed to be constructed at the rear of the property.

A Commission member informed Mr. Nielsen that he would like to have the excess pool water discharged into the detention basin rather than into the swamp as a perpetual condition.  

Mr. Alfieri informed the applicant that he recommends that no large amount (over five gallons) of chemicals, petroleum distillates or fertilizers shall be stored in the shed.

The Commission Chairman stated that there was no one in the audience who had any issues regarding this project.

There was a motion to close the hearing.  The motion was seconded and accepted with a vote of 4-0-1; 4 Yes, 0 No, 1 Abstention.

There was a motion to issue State and Local Orders of Conditions with standard conditions for swimming pools and 2 Perpetual Conditions as stated by the Chairman.  The motion was seconded and accepted with a vote of 4-0-1; 4 Yes, 0 No, 1 Abstention.

                                                                                                      
GENERAL BUSINESS
        Minor Buffer Zone Activity:  191 Grove Street
The applicant has requested the installation of a 4 ft. picket fence along the front of the property.  Mr. Alfieri stated that the homeowner is requesting this for safety reasons.

There was a motion to issue a Negative Determination with 3 Special Conditions.  The motion was seconded and accepted with a vote of 5-0-0.

        Minor Buffer Zone Activity:  49 Hutchinson Street
The applicant has requested the removal of existing lawn and 2 existing plants and replanting of new lawn.  There is a stream abutting the property on one side of the house.  Mr. Alfieri stated that the site is all previously disturbed area.

The Commission requested that the applicant install siltation fence along the side of the property that abuts the stream for erosion control purposes.

There was a motion to issue a Negative Determination with 4 Special Conditions.  The motion was seconded and accepted with a vote of 5-0-0.

        Extension Permit:  Longwalk Estates - SE159-557
Mr. Kevin Rafferty, the applicant, appeared before the Commission to request a three-year extension to the Orders of Conditions for this site.  Mr. Rafferty informed the Commission members that no work has commenced on Lot 1 in this subdivision due to the downturn in the economy.    

The Chairman stated that the original Orders of Conditions were originally issued in September 1997.  

There was a motion to extend the Orders of Conditions for Lot 1 Longwalk Estates for three years.  The motion was seconded and accepted with a vote of 4-1-0; 4 Yes, 1 No, 0 Abstentions.

        Discussion:  Planet Jeep – 505 West Central Street  
Mr. Donald Nielsen, Engineer of Guerriere & Halnon, Attorney, Richard Cornetta, attorney for the applicant, and Mr. John Morrill, the principal of Planet Jeep, all appeared before the Commission for a discussion on the Knights of Columbus site at 505 West Central Street.

Mr. Nielsen stated that there has been a previous site walk and discussion with the Commission members regarding this site and at that time Mr. Calarese was the potential buyer of the property.  

There is a wetland located on the hill on the site which brings drainage to a pipe that runs down to Rt. 140.  The proposed development would encroach into the 25 ft. no disturb buffer zone as well as the 50 ft. buffer.

Mr. Nielsen said that he is seeking the Commission members’ opinion to the proposed development on the site.  The 20,000 sq. ft. parcel would be the future site of the Planet Jeep car dealership.

Mr. Nielsen informed the Commission that this development would result in approximately 1,048 sq. ft. of potential disturbance and would provide 2,000 sq. ft. of replication.  

Mr. Nielsen stated that the applicant would subsequently apply for a variance and provide an alternatives analysis for the site.  The applicant is seeking a preliminary opinion of the site from the Commission.

The car dealership would propose grass swales for the site.  There are 288 parking spaces proposed as well.

The Chairman asked Mr. Nielsen if he would consider decreasing the size of the building and what is the possibility for the building being moved further from the wetlands on the site.  The building could be moved to the east side of the parcel.  The size of the building and number of parking sizes cannot be reduced.

A Commission member noted that there are beech trees on the top of the hill on the site.  This member also inquired if the replication area could be moved towards the east from where it is depicted on the plan.

Another Commission member inquired of the applicant as to what is being proposed for the stormwater; i.e., what will be done with it.  The stormwater will be treated on the pavement and the volume will be controlled underground.

A Commission member expressed concerns over any wetland fills for the site; i.e., the values and functions would be replaced.  The Commission Chairman informed the applicant that if there is a need to fill in any wetlands, they should show that there is no alternative.  The Chairman also informed Mr. Nielsen that the new regulations are now in place and he should propose a plan that complies with these new regulations.

Mr. Nielsen requested that the Commission conduct a site        visit of the property so that they can see for themselves the details of this plan.

        The Commission members will conduct a site walk of the  property with Mr. Nielsen on    Tuesday, May 20th at 7 p.m.
